TERMS and CONDITIONS of the Go and Connect VIP CARD
This deed of agreement is entered into as of the purchase is made BETWEEN:Go and Connect S.L. (to be known as ¨Go and Connect¨ in this agreement) AND: Either purchaser of ¨Go and Connect Card¨ and / or purchaser of ¨Go and Connect VIP Card¨ (to be known as ¨VIP Card Holder¨ in this agreement) WHERAS:¨VIP Card Holder¨ agrees to the given terms and conditions of this agreement until the validation expires.
CLAUSE I: Limitations of usage
Go and Connect VIP Cards are non transferable.
CLAUSE II: Information regarding discounts and / or privileges
All information regarding ¨Go and Connect¨ discounts and / privileges at affiliates will be available through the website of ¨Go and Connect¨. Although ¨Go and Connect¨ does its utmost to ensure that all information provided is correct, “Go and Connect” is not liable for inaccurate or false information, or consequences thereof.
CLAUSE III: Contracting parties
If an affiliate fails to provide the advertised discount, “Cardholder” will inform “Go and Connect”,
who will take appropriate action to remedy this. “Go and Connect” cannot provide compensation for an affiliate’s failure to fulfil their contractual obligation , or consequences thereof.
CLAUSE IV: Risk of loss, theft, and damage
¨Go and Connect¨ will not under any circumstances replace cards that are lost, stolen or damaged.
CLAUSE V: Responsibility
The responsibility of ¨Go and Connect¨ is limited to the price of the card.
CLAUSE VI: Governing law
This agreement is governed by Spanish law, and all parties hereby agree to submit to the
jurisdiction of the courts of the Spanish Kingdom, with respect to this agreement.
CLAUSE VII: Privacy policy
A) Information provided by the “Card Holder” may be used by “Go and Connect” to provide a better service.
B) The discount holder agrees to being contacted by “Go and Connect” through the contact details provided below with information regarding their “Go and Connect VIP Card” membership, and other initiatives of “Go and Connect” and affiliates.
CLAUSE VIII: Disclaimer
¨Card Holder¨ agrees to pay any costs incurred by ¨Go and Connect¨ to enforce the terms of this agreement.
CLAUSE IX: Modification
¨Go and Connect¨ reserves the right to change these terms and conditions without advance notice.
CLAUSE X: Termination
Termination on behalf of ¨Go and Connect¨
¨Go and Connect¨ may terminate this agreement at any time, for any reason. Improper use of the “Go and Connect VIP Card” will result in a non-refundable cancellation of the card.
CLAUSE XI: Refundability
All ¨Go and Connect Cards¨ are non-refundable.
CLAUSE XII: Severability
In case of invalidity of any term, or terms, of this agreement shall not affect any other term of this agreement, which shall remain in full force and effect.
CLAUSE XIII: Validation
A) These cards are might not valid during special events or in combination with other offers, please check with affiliates.
B) The ¨Go and Connect VIP Card¨ will be valid for a period of twelve months, until the date stated on the card.
